COMMUNITY GARDEN WAIVER

You will find that many people will tell you waivers are not worth the paper they are written on. They will say that waivers do not stand up in court. If your organizations goal is to prevent lawsuits and offer 100% protection, those people are right.


However, if your organization's goal is to inform, educate, and to protect your volunteers; then a waiver is a useful "tool." This type of waiver helps to mitigate damages if there is a lawsuit, no document ever offers 100% protection.


Feel free to use this document or to modify it to suit your particular organization. Please note that we removed having a "criminal records check" from the appendix. If you program involves children or vulnerable people you may want to "add it back" into your waiver. Please note that most police departments have a fee for providing this service and during the pandemic, may not be providing them.


Be sure to follow your local health unit's regulations for outdoor activities.
